'Game over, sultan must appoint Azizah'

The Selangor sultan should appoint PKR president Dr Wan Azizah Wan Ismail since she commands the majority in the state assembly, said constitutional expert Abdul Aziz Bari.

"In law dissolution (of the assembly) is not the option now. I dare say it is even against the constitution and democracy.

"There is no need to waste time and money when the majority is clear on Wan Azizah's side

"The law is clear, the sultan must appoint Wan Azizah to allow the state running to go back to normality," he added.

Yesterday, Wan Azizah revealed that she had the support of 30 state assemblypersons, including two from PAS, to assume the menteri besar post.

The Kajang assemblyperson added that the 30 have lost confidence in the leadership of current menteri besar Abdul Khalid Ibrahim.

This prompted Khalid to call on her to prove her support via a vote of no confidence against him in the 56-member state assembly.

However, Aziz criticised the menteri besar over his stand.

"Khalid should be consistent if he wants to retain his credibility and honour

"He did not care to show his claim to have the majority support when the met the Sultan on Aug 11 but now he demands that when Wan Azizah came up with the hard evidence of the majority support actually on her side.

"I still say that the game is over for Khalid," he added.

Palace must act swiftly

The constitutional expert pointed out that the problem now is if the palace drags its feet over the latest development.

"It should have been swift just like when it granted audience to Khalid and took whatever he said at face value.

"The same must be granted to Wan Azizah if the palace is to remain neutral and stay above political fray," he added.

Aziz (right) also noted how the sultan, during his meeting with Khalid, had said that the internal problems in PKR are not of his concern.

Therefore, the constitutional expert added whether PAS agreed with Wan Azizah becoming menteri besar is now irrelevant hence there is no need to wait until the party's Aug 17 meeting to discuss the matter.

Wan Azizah has submitted a second letter to the palace seeking an audience with the sultan after her first request was turned down.

Question mark over legality

Meanwhile, Aziz said since Wan Azizah commanded majority support, a big question mark hangs over the legality of Khalid as menteri besar and the remaining exco members, namely the government of Selangor

"Khalid has a duty to clear that by allowing the house to convene as soon possible without waiting for November.

"This is because the government has to be legal in order to endorse critical decisions which involve contracts and agreements. Going by the book the only option is for Khalid to resign.

"As his hold on government is a big question mark Khalid has no authority to advise the sultan or even continue to sit on the boards of so many state GLCs.

"Such a senario would lead to confusion and chaos," he added.

In view of this, Aziz said the sultan must step in, not to dissolve the house, but grant an audience to Wan Azizah, who has shown the hard evidence.

"If he is still not sure then he needs to convene the house. Khalid has no authority to stop this as his hold to office is in big doubt," he added.

Aziz pointed out that the situation would not have come to this if the sultan had asked Khalid to furnish him with clear proof when he granted him the audience four days ago.
