Isma president’s sedition trial postponed pending lecturer’s High Court challenge

The Kajang Sessions court today allowed a postponement of Ikatan Muslimin Malaysia (Isma) president Abdullah Zaik Abdul Rahman's sedition trial after his lawyer said they wanted to wait for the decision in the case of law professor Dr Azmi Sharom who is challenging the constitutionality of the Sedition Act.
Abdullah was charged after making a controversial remark against the Chinese community. He faces a maximum fine of RM5,000, a maximum jail term of three years, or both, if convicted under Section 4(1)(b) of the Sedition Act 1948.
He courted controversy when he allegedly said the Chinese migrants brought in by the British to Tanah Melayu were “trespassers”, and questioned the citizenship and wealth given to them‎.
Kuala Lumpur Sessions Court judge Zainol Rashid Hussain‎ had agreed that there was a constitutional issue in Section 4 of the Sedition Act, which must be determined by the High Court.
Azmi, a law lecturer with Universiti Malaya, was charged last month with sedition over his comments in a news article titled “Take Perak crisis route for speedy end to Selangor impasse, Pakatan told”.
Outside the Kajang court complex this morning, some 100 supporters ‎stood at the entrance with Isma flags and banners with the words, "Jangan lupa sejarah Malaysia", (don't forget Malaysian history), "Sejarah bukan menghasut" (history is not seditious), "Melayu Islam perjuangan Isma" (Isma's struggle for Malay Muslims), "We are with the truth‎", "Learn from history or become history", and "Bumi ini bumi Melayu Islam" (this land is the land of Malay Muslims).
Earlier in court, Abdullah's lawyer Salim Bashir ‎said there was a possibility that Azmi would succeed in his constitutional challenge and as such, it would be unfair for the trial to go on.
Azmi's case is fixed for case management at the KL High Court today.
DPP Mohd Abazafree Mohd Abbas did not object to the postponement application although he informed the court that they were ready to proceed with the trial as well.
Judge Nor Hazani Hamzah allowed the postponement and fixed December 22 for mention.
