The water-restructuring agreement between Selangor and Putrajaya cannot be revealed based on the advice from the Attorney-General's Chambers (AGC), minister Datuk Seri Dr Maximus Johnity Ongkili said today.
The Minister of Energy, Green Technology and Water also said the water concession companies involved in the restructuring exercise also had to give their consent for the agreement to be disclosed to the public.
"We received advice from the AGC and it is not the time yet to disclose the water agreement," he told reporters after an event at the Kuala Lumpur Convention Centre today.
"If the Selangor government wants the water agreement declassified so that the public can view it, it will need the agreement of all parties concerned, and there will be reasons why the disclosure cannot be made because it depends on discussions with the concession companies."
He added that there might be concerns about stock market speculation on the companies' shares.
Ongkili was responding to new Selangor Menteri Besar Azmin Ali, who said he would write to the federal ministry to request that the water-restructuring agreement is declassified from the Official Secrets Act.
Ongkili said the federal government had done its part in the Selangor water-restructuring exercise and it was now up to the state government to settle outstanding issues with the concession companies.
Of the four water concessionaires in Selangor, Syarikat Pengeluar Air Selangor (Splash) is the only company which has refused the initial buy-out.
Puncak Niaga, Syabas and Kumpulan Abass had agreed to the takeover with the deal costing the state government RM7.8 billion.
The master agreement is aimed at taking over operations of the RM30 billion Selangor water industry from four private companies and returning it to public ownership.
The industry will now be run and controlled by state government entity Air Selangor.
Ongkili said the state government has five weeks left from the two months given to it to settle issues with the remaining concessionaire.
"The federal government has fulfilled its responsibility, it is now for the state government to finalise terms.
"If no agreement is reached at the end of the two-month period, the ministry will enforce Section 113 of the Water Services Industry Act," he said. This clause will allow the federal government to take over the concession company. –TMI
