Nov 4 D-DATE for Borneo church’s bid to use 'ALLAH'
KUALA LUMPUR - The High Court fixed Nov 4 for case management of Sidang Injil Borneo (SIB) church's bid for declarations, including that it has the right to use the word "Allah" in its religious publications and practice.
SIB's counsel Lim Heng Seng confirmed today that deputy registrar N.D. Arun set the date to give further directions on the action which was triggered by a 2007 seizure of religious books that SIB imported from Surabaya, Indonesia.
The church on May 5 was denied leave by the High Court here to proceed with its legal action against the Home Minister and the government.
However, the Court of Appeal on Oct 1 granted leave to SIB and its president Reverend Datuk Jerry W.A. Dusing@Jerry W. Patel, and
ordered the High Court to hear the matter.
The government on Oct 24, 2007, ordered SIB to stop importing children's religious books under six titles. It deemed the books offensive because they contained four words used in Islam: "Allah", "Baitullah", "Solat" and "Kaabah".
SIB and Dusing later on Dec 10 filed a leave application for a judicial review to quash the government decision to seize the books.
They claimed the Customs Department had confiscated the books containing the word "Allah" at the Low Cost Carrier Terminal in Sepang in August that year.
The books were returned to SIB on Jan 25, 2008, and SIB and Dusing then withdrew a portion of their application seeking to squash the confiscation decision.
However they still seek declarations that:
* They have the constitutional right to use the word Allah in all their religious publications and materials;
* SIB's congregation - a majority of whom are Bahasa Malaysia-speaking natives, is entitled to own, possess, use and import materials notwithstanding the use of the word Allah in those publications; and
* The government ban on the usage of the four words is unconstitutional. -NST
