Why delay revealing finding into Shafee’s sworn statement, PKR asks A-G

PKR has questioned the Attorney-General's Chambers’ delay in revealing the outcome of an investigation into Tan Sri Muhammad Shafee Abdullah, who allegedly filed false affidavits in response to Datuk Seri Anwar Ibrahim’s application to disqualify the Umno lawyer from prosecuting his sodomy case.
The party’s legal adviser, Sivarasa Rasiah, said it has been almost five months since investigators recorded a statement from retired police officer Datuk Mat Zain Ibrahim, who claimed in a statutory declaration that some of the contents of Shafee’s affidavits were false.
"The A-G's Chambers issued an order to investigate because there is credible suspicion against Shafee," he told The Malaysian Insider.
On Tuesday, Anwar failed in his final attempt to remove Shafee as deputy public prosecutor.
A day earlier, PKR central executive council member Manivanan Govin had lodged a police report, asking why police only recorded Mat Zain's statement in May, four months after the A-G's Chambers’ order to investigate on January 3.
"The investigation only began after Anwar's acquittal was set aside by the Court of Appeal on March 7," Govin said in his report.
He also questioned Shafee’s appointment as DPP in Anwar's case when the status of the investigation against the lawyer remained unclear, adding that the court had also not been told of the order to investigate.
Mat Zain, a former Kuala Lumpur Criminal Investigation Department chief, told The Malaysian Insider that he only knew of the A-G's January 3 order to investigate Shafee’s affidavits on May 19 when police approached him to record his statement.
Anwar filed the application to remove Shafee last December 6 based on the claims in Mat Zain’s statutory declaration made public a few days earlier.
Gani had appointed Shafee as ad hoc DPP in July last year to lead the prosecution in the government’s appeal against Anwar’s acquittal on a charge of committing carnal intercourse with his former aide, Mohd Saiful Bukhari Azlan, in 2008.
Mat Zain, in his 31-page SD, said he went with Shafee and former Commercial Crime Investigation Department director Datul Ramli Yusof to former prime minister Tun Dr Mahathir Mohamad's house during Hari Raya last year, where they allegedly discussed the wrongdoings of Gani.
Mat Zain lodged three police reports last December after learning that some contents in Shafee's affidavits filed in the Court of Appeal were false.
He also alleged that Shafee had suppressed material evidence with the intention of deceiving the court.
In March, the Court of Appeal sentenced Anwar to five years' jail, but granted him a stay on the sentence pending his appeal to the Federal Court.
The prosecution has also filed a cross-appeal for a heavier jail sentence.
