Man who was blindfolded, beaten sues police, govt

polis beatenKUALA LUMPUR: A former supermarket security manager has sued the police and Malaysian government for RM600,000, alleging physical injury and negligence while being detained.
S Selvarajah, 55, filed the lawsuit through Messrs A Sivanesan at the High Court registry last October; the media obtained his statement of claim when the case was brought for mention today, before Justice Rosnaini Saub.
His lawyer K Ponnusamy told reporters that the court had fixed January 19 for case management to set the trial date.
The plaintiff named investigating officer Inspector Mohd Hanis Abd Wahab, Police Retirees’ Affairs Management assistant director ACP Zakaria Pagan and Bukit Aman CID director Mohmad Salleh as first to third defendant.
He named Inspector General of Police Khalid Abu Bakar and the Malaysian government as the fourth and fifth defendants.
In his statement of claim, Selvarajah said on September 4, 2012, he was detained while at the Kepong police station to provide more information on his police report.
He had earlier lodged a report about a robbery at the Tesco Selayang supermarket by four suspects armed with machetes, who escaped with RM500,000. He claimed that Mohd Hanis brought him to the Jinjang lockup to investigate the case he had reported.
He claimed the first defendant then obtained a one-day remand order on him from the Kuala Lumpur Magistrate’s Court on September 5, 2012. The same day, Mohd Hanis and other officers brought him to the Kepong police station where they blindfolded and beat him up, he alleged.
Selvarajah claimed that he sustained serious injuries to his feet, knees, and head in the alleged incident. He claimed that the incident had incapacitated him and as a result, was unable to work or carry out daily activities.
The plaintiff also alleged that the rest of the defendants had failed to ensure his safety while he was in detention and failed to release him on police bail although he had been the victim and not the suspect in the robbery.
On September 6, 2012, Selvarajah was released on police bail after the Magistrate’s Court rejected the first defendant’s application to extend his remand.
