WAKE UP AHMAD SHABERY! As stakeholder, Bernama broke the law by not paying their TV staff - Nie Ching
Section 18 of the Employment Act 1955 says that a wage period cannot exceed a month and section 19(1) of the Act states that “every employer shall pay to each of his employees not later than the seventh day after the last day of any wage period the wages, less lawful deductions earned by such employee during such wage period”.
Therefore when Bernama TV failed to pay its staff their salary on time in November, it has committed an offence under the Employment Act.
It is also provided in the Employment Act that where an offence under the Act has been committed by a body corporate, any person who is a director, manager, or other similar officer of the body corporate at the time of the commission of the offence, shall be deemed to have committed the offence and may be charged jointly or severally in the same proceedings. Upon conviction, they can be fined not exceeding RM10,000.
Bernama is the national news agency of Malaysia and it owes a third of BTV. It is a shame that a statutory body is now involved in exploiting its staff.
Not only BTV needs to pay its staff immediately, Communications and Multimedia Minister Ahmad Shabery Cheek should also reveal plan to turn BTV into a profit-making company.
According to the CEO of BTV, it is Bernama that has been paying the salaries when BTV came into financial problem. If that is the case, what were the contributions from the rest of shareholders?
