In her judgment, Su said the court was satisfied that Kok's arrest was lawfully done, as the police had the power to detain Kok under section 73 (1) of the ISA.
Kok was arrested after a complaint was lodged against her for allegedly telling mosque officials in Kota Damansara, Sri Serdang and Puchong Jaya to tone down the azan or Muslim call to prayer.
On September 12, 2008, Kok filed a suit against former home minister Tan Sri Syed Hamid Albar at the Kuala Lumpur High Court.
She also named then inspector-general of police, Tan Sri Musa Hassan, special branch senior officer, DSP E Kim Tien and the government of Malaysia as the second, third and fourth defendants.
