Gerakan today filed a fresh motion in the Federal Court registry to challenge the Islamic Criminal Law Enactment 1993 (II) Amendment 2015.
"We filed the motion under Article 4(3) and 4(4) of the Federal Constitution to declare the enactment null and void as it is inconsistent with the Federal Constitution," lawyer Andy Yong Kim Seng said in a Whatsapp message to The Malaysian Insider.
He said despite the setback in the Kota Bahru High Court yesterday, Gerakan remained committed in defending the Federal Constitution and its basic structure.
Yong said the applicants in this case also believed that the Kelantan State Legislative Assembly has acted beyond its legislative powers by enacting criminal laws and matters that are part of the Federal Legislative List.
