Latheefa: Absurd to say Bersih rally is illegal

There is no such thing as an illegal assembly under the PAA 2012, and no consent is required because the gathering is in the 'vicinity' of Dataran Merdeka, says PKR leader.

KUALA LUMPUR: The police have no right to declare an assembly illegal because there are no provisions in the law to do this, PKR central council member Latheefa Koya said today.
Latheefa was referring to a statement by Kuala Lumpur chief police officer Tajuddin Md Isa that Bersih 4.0 is illegal.
She said Tajuddin’s statement was without any legal basis, arbitrary and in breach of the provisions of the Peaceful Assemble Act (PAA) 2012.
“The police are duty-bound to uphold the law, and not disregard it.
“The PAA 2012 does not contain any provision that allows the police to declare an assembly illegal or to prohibit it,” Latheefa said in a press statement today.
She said obtaining permission from the authorities to hold a gathering under the repealed section 27 Police Act 1967 had been done away with under the PAA 2012.
“There is no such thing as an illegal assembly under the PAA 2012,” he added.
Latheefa said it was absurd for Tajuddin to claim that the organisers’ failure to get the owners’ consent under section 9 had rendered the rally illegal.
“No such consequence is stated in the PAA. In fact, failure to obtain the consent of the owner is not even an offence under the PAA,” she said.
She added that no consent was required because Bersih had announced that they would only be gathering in the “vicinity” of Dataran Merdeka.
Latheefa said the police and Home Ministry must stop lying to the public that Bersih 4.0 was illegal.
