The amended statement of claim on the suit filed by Shaariibuu Setev on the death of his daughter Altantuya has finally made its way to co-accused Sirul Azhar Umar at the Villawood Immigration Detention Centre in Sydney, Australia.
Lawyer Ram Karpal Singh confirmed with Malaysiakini today that the private process server his firm hired, after the Foreign Ministry failed to deliver the papers, has managed to serve them on Sirul.
“I will get an official notice of confirmation from the process server. Following that, I will inform the High Court in Shah Alam,” Ram Karpal said when contacted.
The next case management for the case is on Wednesday, Oct 26, before Justice Ahmad Nasfy Yasin.
It was previously reported that the law firm had given the sealed documents to the Foreign Ministry at Wisma Putra, for it to dispatch to the Malaysian High Commissioner in Australia, as this was part of the court requirement.
Last month, Ram Karpal (photo) said they had to hire a private process server to deliver the papers as there had been no reply on this from the Foreign Ministry officials.
Sirul has been detained at the centre since he was arrested by the Australian authorities after being placed on alert through Interpol. He had fled to Australia before the Federal Court verdict was announced.
Sirul along with Chief Inspector Azilah Hadri were found guilty and sentenced to death by the Federal Court on Jan 13, 2015, for Altantuya's murder between 10pm on Oct 18 and 1am on Oct 19, 2006, in a forest near Puncak Alam in Shah Alam, Selangor.
Setev, along with Altantuya's children, Mungunshagai Bayarjargal and Altanshagai Munkhtulga, had filed an RM100 million suit on June 4, 2007, over her death. The amendment to their statement of claim had to be made to acknowledge the conviction of Sirul and Azilah.
They named Azilah, Sirul, political analyst Abdul Razak Abdullah Baginda and the Malaysian government as defendants in the suit.
Abdul Razak was charged with conspiring with Azilah and Sirul to kill Altantuya, 28, in 2006.
However, the political analyst was acquitted of the charge in October 2008, without having to enter his defence, while Azilah and Sirul were found guilty by the High Court in Kuala Lumpur in 2009.
On Aug 23, 2013, the Court of Appeal allowed the appeal by Azilah and Sirul and acquitted them.- Mkini
